In their latest ILO Article, Claudia Csáky and Sarah Kasslatter provide an overview of the latest CJEU case law on the liability of operators of online marketplaces for trademark infringements by third parties. The occasion is a recent decision of the CJEU regarding high heels copying the signature red sole design of the luxury brand Louboutin, in which the Court ruled for the first time that – and under which circumstances – operators of online marketplaces offering both their own and third-party goods can be held liable for trademark infringements by third-party sellers.
