The latest ILO article of Jakob Widner and Sarah Micheuz deals with a recent decision of the ECJ in which it was determined that Austria’s provision in the Annual Leave Act mandating that employees are not entitled to an allowance payable in lieu of paid annual leave if they withdraw from the employment relationship early and without cause is contrary to EU law. Henceforth, the allowance will be payable regardless of how and why the employment relationship was terminated.
